Keeping in mind that the consumer alert issued by Toyota is still a voluntary recall, you might have trouble getting the car dealer to take back the vehicle. One might argue that the dealer should have given you the heads up, but because the recall is voluntary perhaps the dealer has no obligation legally to disclose such defect. I'd suggest contacting a lemon law attorney in your state. Depending on where you live, there might already be some laws in place that will help you figure out your next step.
